The Labour Law of the People's Republic of China (《中华人民共和国劳动法》) has governed working time, overtime and rest since 1 January 1995. Its core requirements:

- Standard working hours: no more than 8 hours per day and 44 hours per week on average (40 hours under the State Council provisions).
- Overtime is capped: generally no more than 1 hour per day (up to 3 hours for special reasons) and 36 hours per month.
- Overtime pay: 150% of wages for ordinary overtime, 200% on rest days, 300% on statutory holidays.
- Employees are entitled to statutory holidays, paid annual leave and at least one rest day per week.
